Terms of Use (CGU) – ShakeTheMap

These Terms of Use ("Terms") govern the access to and use of the ShakeTheMap website and platform ("Platform") operated by NAAS S.à r.l.-S, a société à responsabilité limitée simplifiée incorporated under Luxembourg law, with its registered office at 370, route de Thionville, L-5884 Hesperange ("ShakeTheMap", "we", "us" or "the Company").

By accessing the Platform, browsing the site, or creating an account, you (“User”, “you”) expressly agree to be bound by these Terms. If you do not accept these Terms, you are not authorized to use the Platform and must cease access immediately.

1. Purpose of the Platform

  1. The Platform is designed to provide an online service enabling direct interaction between job seekers (candidates) and recruiters posting job offers.
  2. The Platform does not act as an employer, employment guarantee, or placement agency and is strictly an intermediary technical service facilitating connections.
  3. Services provided include:
    • For candidates: browsing and searching job offers, creating and managing a profile, receiving personalized alerts, viewing job locations on a geolocated map, applying to jobs, and communicating with recruiters via a secure internal messaging system;
    • For recruiters: creating and publishing job offers, viewing anonymized candidate profiles, tracking received applications, and communicating with candidates via a secure internal messaging system;
  4. The AI feature is only activated at the User's initiative by voluntarily clicking the dedicated button. No content is transmitted automatically to the AI.

2. Access to the Platform and General Conditions

  1. Access to the Platform is strictly limited to individuals aged 18 or older.
  2. Users commit to using the Platform in good faith and in strict compliance with Luxembourg, European, or international laws and public order, as well as respecting morality and good customs in force.
  3. Users must provide accurate, complete, and up-to-date information when creating an account and must update this information as necessary.
  4. Users are solely responsible for the confidentiality of their login credentials and for all activities conducted through their account, whether or not initiated by them.
  5. The "candidates" and "job offers" maps are publicly accessible. However, candidate personal data are only viewable by recruiters with the candidate's consent and only in approximate form for geolocation purposes.

3. Account Creation and Management

  1. Account creation is required to access advanced Platform features, including applying to job offers, posting job offers, or using the internal messaging system.
  2. Creating an account implies explicit acceptance of these Terms and the Privacy Policy, which is a separate but integral document.
  3. Users may edit, complete, or delete their account at any time using the Platform's account management features.
  4. ShakeTheMap reserves the right to temporarily or permanently suspend access for any User in the event of violation of the Terms, abusive behavior, legal non-compliance, or attempted fraud.

4. Personal Data and Geolocation

  1. Candidate addresses are used to display their approximate location on the map accessible by recruiters. This approximation ensures that the exact address is not disclosed without the candidate's consent.
  2. Recruiter addresses are displayed precisely on the map accessible by candidates to allow accurate geographic searches.
  3. When accessing a map, a User may choose to enable precise geolocation:
    • If the User accepts, their exact location is used solely for their personal use, to view nearby offers or candidates.
    • This location will never be shared with third parties or made public, except for the approximate display of candidates on the recruiter map.
  4. Personal data collected is used exclusively for matching, profile personalization, and sending relevant alerts.
  5. Regarding candidate profile visibility: by default, the profile is private and invisible on the map. Users can choose to make it public. If the profile is public, only certain semi-anonymized information is visible: years of experience, job title, and approximate location. Motivations and professional expectations are displayed only to registered recruiters, while the name and past or current employers remain blurred. This complete personal information is only revealed when the candidate accepts an invitation or contacts a recruiter, with an explicit reminder. This approach ensures GDPR compliance while enabling effective matchmaking.

5. Paid Services and Credits

  1. Currently, the use of the Platform is entirely free for all users, both candidates and recruiters. No payment or credit purchase is currently required to access the Platform's basic features, including creating and publishing job offers or using the internal messaging system.
  2. In the future, certain services, such as publishing additional job offers or complementary features, may be subject to payment via a credit system. The number of credits required and their price would then be indicated on the Platform.
  3. If a credit system were to be implemented, credits would be valid for 12 months from their purchase date and would not be refundable under any circumstances.
  4. Each job offer published via credits would have a duration of one month and could be renewed according to the terms indicated on the Platform, with prior notification to the User.
  5. Payment for credits would be made via secure credit card, and any payment made would imply full and complete acceptance of the transaction terms.

6. User Obligations

  1. Users commit not to post illegal, defamatory, offensive, discriminatory, or sexually explicit content, and not to introduce viruses, malware, or any other element that could harm the Platform or its users.
  2. Users are prohibited from attempting to circumvent security measures, from collecting data en masse, or from using the Platform for unauthorized commercial purposes.
  3. Users must respect the rights of other users, including the right to privacy and personal data protection.

7. Liability

  1. ShakeTheMap acts strictly as a technical intermediary facilitating connections between candidates and recruiters.
  2. ShakeTheMap does not guarantee the accuracy, completeness, or veracity of information posted by users and cannot be held responsible for the conclusion of an employment contract or any other transaction between users.
  3. ShakeTheMap's liability is exclusively limited to direct and foreseeable damages caused to the User by a proven breach of its contractual obligations.
  4. Liability cap: under no circumstances shall ShakeTheMap's cumulative liability exceed 100 EUR per user and per event.
  5. ShakeTheMap shall not be held liable to the User for direct or indirect, material or intangible, foreseeable or unforeseeable damages resulting from the use of the Platform or associated services, including server or network malfunctions, force majeure, or actions of third parties.
  6. Users acknowledge and accept that use of the Platform is at their own risk.

8. Intellectual Property

  1. All elements of the Platform (text, visuals, mascots, logos, software, databases) are the exclusive property of ShakeTheMap or its partners.
  2. Users retain ownership of content they publish (CVs, messages, documents) but grant ShakeTheMap a worldwide, non-exclusive, royalty-free license to use such content on the Platform for connection purposes.

9. Duration and Termination

  1. These Terms apply throughout the entire period of use of the Platform by the User.
  2. ShakeTheMap may suspend, restrict, or terminate User access in case of violation of the Terms or abusive behavior, without prejudice to any legal action the company could undertake.

10. Governing Law and Jurisdiction

  1. These Terms are governed by Luxembourg law.
  2. Any disputes regarding the interpretation, execution, or validity of these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Luxembourg-City, notwithstanding the presence of multiple defendants or third-party claims.
